PRESENTATION


Chauffeur-montpellier.fr is a transport service, a simplified  company, registered with the Paris Trade and Companies Register (hereinafter the “Company”). The Company provides a chauffeur-driven passenger vehicule travel service operating exclusively on reservation,  in advance.
These General Conditions constitute the contract by which the company offers and provides the Service and apply to vehicle orders placed by the customer with the company by telephone, by Internet via the site www.c Chauffeur-montpellier.fr.
By using the service, the customer acknowledges and accepts all the terms of these general conditions.

1.0 PURPOSE OF THE SERVICE

The company provides a transport service and provides its customers with passenger vehicles with driver.

 

2.0 BOOK A CAR

The customer is informed that all the vehicles offered are of a single model (sedan). For the moment, the company is unfortunately not able to offer connection with specific car adapted to people with reduced mobility.
The Service is open every day, 24 hours a day, and is only accessible by reservation, in advance.

 

2.1 PREREQUISITE

The reservation of a race via the site is subject to the prior acceptance by the customer of these General Conditions.

 

2.2 STAGES OF RESERVATION

To book, the customer connects to the site by entering his reservation. He fills in the various fields relating to the desired journey (place of departure, possibly a place of destination, type of car). In the absence of information on the place of departure, the ordering process cannot be completed. If a place of destination is entered, the company offers a price for the requested journey. The customer is free to accept or not the offer proposed by the company; if he accepts it, he must first ensure that all the information displayed is in accordance with the desired route.
If a place of destination is not entered, the reservation will not be successful.
The company transmits the elements of the Order to the driver responsible for the daily journey.

 

2.3 ADVANCE BOOKING

The customer can reserve a vehicle with the company before the date and time of the start of the race in question. The delay can be from 1 month maximum up to 30 minutes minimum before the scheduled departure time.
The customer indicates the date, time and place of departure, any intermediate stages and the final point of arrival, any other particularities of the race (, additional indication for the meeting place, etc.), as well as the first and last names of the passenger.
Depending on the number of orders already registered on the date and time chosen, the company reserves the right to refuse additional advance orders.
The Company records the order and takes into account the search for the vehicle, without making an immediate reservation of a vehicle at the time of the order. The vehicle search is carried out in the hour preceding the scheduled departure time, depending on the place of departure and the traffic conditions.

 

2.4 RESERVATION FROM AN AIRPORT

When booking, the customer must specify the airport, the date of the race, and the flight number.
The scheduled landing time as well as the arrival terminal, subject to change by flight conditions and the airport administration, can be provided but are not contractual.
The company cannot be held liable in the event of incorrect information indicated by the Customer (incomplete flight number, date error), nor in the event of incorrect information relating to the reference flight for the race, transmitted by the Service. Info of the airport concerned.

 

2.5 BOOKING BY TELEPHONE

The telephone ordering service is done 12 hours a day, 7 days a week by means of a call to a “non-surcharged” number (cost of a local call from a landline).

 

2.6 BOOKING THROUGH THE WEBSITE

The customer can place an order online 24 hours a day, on the website www.Chauffeur-montpellier.fr
The online reservation redirects upon validation to a secure Paypal site. No additional costs are charged by the company on the price of the trip, apart from the possible additional cost due to the waiting time of the passenger by the driver at starting point.

 

2.7 CLIENT'S OBLIGATION

After validation of the reservation, the customer must arrive at the agreed location on the scheduled day and time.
The customer will receive a confirmation email and / or sms.
If the driver is waiting, waiting costs, the amount of which is determined in article 5, will be automatically billed to him beyond a period of 8 minutes.
In the event of the Client's no-show, the Driver is deemed free to leave after a 10-minute waiting period.
The customer agrees to behave on board the vehicle like a good father.
In the event of damage to the equipment or vehicle attributable to the Customer, the Company will re-invoice him for the costs of repairing the vehicle or changing the equipment.
Passengers, adults and children, are required to fasten their seat belts. A fine is incurred by people caught in default during a control by the police.
For safety reasons, it is forbidden to smoke and transport flammable, explosive, corrosive or toxic substances. Failure to comply with this stipulation engages the responsibility of the Customer and the passenger. The Company then reserves the possibility of any possible recourse.
Luggage must be placed in the trunk of the vehicle. Luggage remains the sole responsibility of the Customer. No luggage can be entrusted to the driver. The driver may refuse baggage of excessive weight or dimensions, as well as those he considers prejudicial to the safety of transport.
Any modification of the estimate of the trip initially planned and paid in advance through the site (waiting, parking, additional stop, change of address ...) will result in additional costs which are billed to the customer directly from the driver.

 

2.8 COMPANY'S OBLIGATIONS

The service offered by the company consists of a search service for an available vehicle corresponding to the customer's reservation. The company is thus bound by a simple obligation of means and implements all its best efforts to find a vehicle available to the Customer as soon as possible.
Upon receipt of the Customer's request, if the place of destination is entered, the company undertakes to provide an offer indicating the price of the journey.
If the customer accepts the offer, the company undertakes to send him a confirmation of the Order by email and / or sms.

 

3.0 CANCELLATION OF BOOKING


All cancellation conditions are defined in these General Conditions.
If the vehicle has already arrived at the place of departure at the time of cancellation, the race will be totally due to the company. If the customer has not canceled the order before the arrival of the vehicle, if the passenger does not show up at the place of departure where the driver or the company calls the customer on the phone, the full value of the trip ordered is invoiced at customer.
The customer retains the possibility of canceling the Order 3 hours before the actual start time of the race. In this case, the full amount of the race will be refunded. But otherwise he runs the risk of owing the entire amount of the race to society.

 

4.0 CONFIDENTIALITY-PROTECTION OF PERSONAL DATA


These General Conditions are subject to the provisions of Law No. 78-17 of January 6, 1978 relating to information technology, files and freedoms.
The customer has the right to access, rectify and delete personal data concerning him on simple request to the company.
The company informs the customer about the use made of personal data concerning him collected in connection with the use of the site
The company may communicate the customer's contact details to third parties for the purposes of using the site and in particular to the Driver. The Customer has of course a right of opposition (by any means and in particular by ordinary mail addressed to the company) to the transfer to third parties for the purposes of commercial prospecting of personal information held on his person.
The customer accepts that the company reserves the right to record and keep, for the purposes of proof, all information relating to the connections made, such as data relating to journeys made and the Customer's personal contact details.

 

5.0 WITHDRAWAL CHARGES


The waiting costs amount to € 0.45 and € 0.90 incl. Tax per minute depending on the range of vehicle and will be payable in addition to the driver. 5 minutes of waiting are free. Beyond 10 minutes the driver can leave if his schedule requires him

 

6.0 PAYMENT


Payment can be made directly on the site through the secure Paypal site, or directly to the driver through a bank card terminal or cash.

 

7.0 ISSUANCE OF THE INVOICE


Once the reservation has been paid online, or booked directly by telephone with the central, the company sends the customer, by email, an invoice directly to the email address that he will have communicated during the reservation.

 

8.1 SCOPE OF TRANSFER


The transfer begins when the customer gets into the driver's vehicle and ends when the customer gets off the same vehicle.

 

8.2 CUSTOMER SUPPORT


The driver can refuse to take charge of the customer. If such a refusal results from the behavior of the customer (state of intoxication, presence of an animal whose weight exceeds 8 kg and not placed in a cage, danger for the safety of the driver and the vehicle, etc.) or incorrect information transmitted by the client.

 

9.1 COMPLIANCE WITH REGULATIONS


The company is committed to ensuring that drivers and vehicles comply with the regulations in force regarding the operation of passenger vehicles with drivers.

 

9.2 INSURANCE


The company is guaranteed by a well-known solvent insurance company which covers the risks linked to its activity in accordance with the legislation in force.
Passengers are considered as third parties vis-à-vis the driver, and are covered for all bodily, material and immaterial damage that they could suffer as a result of a traffic accident and this unlimited for bodily injury. , from boarding the Vehicle to descending, with the exception of damage caused by their fault.

 

10.0 COMPLAINTS


The customer can send a complaint by registered letter with acknowledgment of receipt (LRAR) to the company at the following address: CHAUFFEUR MONTPELLIER, 100 Rue de la peyriere, 34430 SAINT JEAN DE VEDAS, FRANCE. Any complaint relating to an incident occurring during the race will be forwarded to the Driver, whose company undertakes to provide the exact contact details upon request from the Customer.

 

10.1: APPLICABLE LAW AND COMPETENT JURISDICTIONS


These General Conditions are subject to French law.
Disputes between traders will be submitted exclusively to the Paris Commercial Court.
